Terms of Service

1. Acceptance of Terms

By accessing or using the FastCRW web crawling API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

FastCRW provides an API-based web crawling and scraping service that enables users to extract, process, and structure data from web pages. The Service includes features such as single-page scraping, multi-page crawling, site mapping, content extraction, and LLM-ready data formatting. Access to the Service is provided through API endpoints authenticated via API keys.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or API keys.

4. API Usage & Rate Limits

Your use of the API is subject to the rate limits and concurrency limits associated with your subscription plan. You agree not to circumvent or attempt to circumvent these limits. We reserve the right to throttle or suspend access if your usage patterns indicate abuse or excessive load on our infrastructure.

5. Credit System & Billing

The Service operates on a credit-based system. Each subscription plan includes a monthly allocation of credits. Credits are consumed based on API operations performed. Unused included credits do not roll over to the next billing period. Additional credits may be purchased as top-ups. Payments are processed by Stripe and are non-refundable except as required by applicable law. You are responsible for all charges incurred under your account.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You shall not use the Service to:

• Crawl or scrape websites in violation of their terms of service or robots.txt directives
• Collect personal data without proper legal basis or consent
• Engage in any activity that constitutes harassment, abuse, or harm to others
• Attempt to gain unauthorized access to any system, network, or data
• Distribute malware, spam, or any harmful content
• Interfere with or disrupt the Service or its infrastructure
• Resell, redistribute, or sublicense access to the Service without authorization
• Use the Service for competitive intelligence gathering against FastCRW

7. Intellectual Property

The Service, its original content, features, and functionality are owned by FastCRW and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you extract using the Service, subject to the intellectual property rights of the original content owners. You are solely responsible for ensuring your use of extracted data complies with applicable laws and the rights of third parties.

8. Data & Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree to the collection and use of information as described therein. Crawled data is processed transiently and is not stored on our servers beyond the time needed to deliver API responses, unless explicitly requested by you through caching features.

9. Service Availability & SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, updates, or modifications to the Service with reasonable notice when possible. We are not liable for any downtime, data loss, or service interruptions.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

IN NO EVENT SHALL FASTCRW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless FastCRW and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FastCRW operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
